Countering Foreign Improper Extraterritorial Jurisdiction 反外国不当域外管辖

How this regime is organized

The State Council legal-affairs department, together with other relevant authorities, conducts the identification process and may announce that a foreign measure constitutes improper extraterritorial jurisdiction. Under working-mechanism procedures, authorities may take country-level countermeasures, list foreign organizations or individuals on the Malicious Entity List, or issue a prohibition-of- execution order to an organization or individual that executes or assists the foreign measure.

When it applies

• A foreign state implements an extraterritorial-jurisdiction measure in violation of international law or the basic norms of international relations.
• The measure harms China's sovereignty, security or development interests or the lawful rights and interests of Chinese citizens or organizations.

Outputs and measures

• Determination that a foreign measure constitutes improper extraterritorial jurisdiction 认定有关措施构成外国不当域外管辖措施
• Prohibition-of-execution order (禁执令) 禁止执行外国不当域外管辖措施的决定（禁执令）
• Listing on the Malicious Entity List (恶意实体清单) 列入恶意实体清单
