When the working mechanism decides to issue a prohibition order under the 2021 Rules, MOFCOM publishes the order. Reports and exemption applications are submitted to the State Council commerce department.

When it applies

  • The extraterritorial application of foreign legislation or measures violates international law or the basic norms of international relations.
  • That application improperly bars or restricts Chinese parties from normal economic, trade or related dealings with third countries.

Procedure

  1. Report

    A Chinese citizen, legal person or other organization reports the foreign prohibition or restriction within 30 days.

  2. Assessment

    A working mechanism assesses the reported foreign legislation or measure.

  3. Prohibition order

    The working mechanism may decide that MOFCOM publish a prohibition order barring acknowledgment, execution or compliance.
